Gregory Wright Denied DP Case Review by 5th Circuit -- Wife Speaks Out

The 5th Circuit Federal Court of Appeals, on November 17th 2006, released the decision to deny Gregory Wright, currently on Death Row at Polunsky, Texas, a Certificate of Appealability (05-70037). His wife, Connie, appeals for help, letters of support, and prayers.

Livingston, Texas (PRWeb) November 22, 2006 -- Disbelief and anger sum up the response of Gregory Wright's wife, relatives and friends as news of the 5th Circuit verdict (05-70037) reached them on Friday. After an emotional few hours, during which Connie rushed to be the first to give her husband the bad news, a quiet determination to ensure this decision did not prevail replaced the emotion.

The issues presented by Greg's appeal for a C.O.A. were:

1. That it was wrong to apply Texas's contemporaneous object rule to bar relief where his trial attorney had alluded to the underlying legal principles of the Confrontation Clause by objecting to a co-defendant's statement as unreliable hearsay.

2. That Greg's attorneys failed to lodge their objections to that statement in the correct form to safeguard his constitutional rights, thereby undermining confidence in the trial outcome.

3. That the state's violations of Brady v. Maryland caused sufficient prejudice to grant the defendant a new trial or punishment phase, and should be assessed on the basis of error accumulation, including that of improperly withheld evidence by the State.

The Court denied all three claims. Greg has been told by his attorney that he has 90 days to file an appeal with the Supreme Court.

We have to remember that and be strong for our Greg," said Connie Wright.

The campaign to return Greg's case to the courts will continue. Further support and investigation is sought, and both Greg and Connie appeal to concerned and interested persons and organizations to join this fight.
